By using RackNode’s services, you agree to be bound by these T&C and our Acceptable Use Policy (AUP).

2. Services Provided

1. Scope of Services: RackNode offers a variety of hosting solutions, including shared hosting, virtual private servers (VPS), dedicated servers, cloud hosting, and other related services as described on our website or through direct communication.

2. Service Details: Each service plan includes specific features, limitations, and pricing that are clearly stated on our website or in any applicable order forms and documentation provided to you.

3. Account Setup and Client Information

1. Accurate Information: You must provide complete and accurate information when creating an account. This includes (but is not limited to) name, address, contact details, and payment information.

2. Updates: You must keep your account information current. Failure to do so may result in service suspension or termination.

3. Security: You are responsible for maintaining the confidentiality of your login credentials. You must notify RackNode immediately if you suspect unauthorized use or security breaches in your account.

4. Acceptable Use and Content Restrictions

1. Compliance with AUP: You agree to comply with our Acceptable Use Policy (AUP), which is incorporated into these T&C by reference. The AUP outlines prohibited activities and content restrictions.

2. Policy Violations: Any violation of these T&C or the AUP may result in suspension or termination of your account without prior notice.

5. Payment, Renewal, Cancellation, and Refund Policy

1. Billing & Payment:

All services are billed in advance in accordance with the billing cycle stated on our website or your order.

You are responsible for ensuring timely payment. Unpaid invoices may lead to service interruption or termination.

2. Renewals:

Services automatically renew unless canceled before the next billing date.

Renewal fees are charged at the prevailing rate unless otherwise stated.

3. Cancellation:

You may request cancellation of any service through the specified method in your account dashboard or by contacting support.

Cancellation requests must be made prior to the next billing cycle to avoid additional charges.

4. Refund Policy:

15-Day Money-Back Guarantee: We offer a 15-day money-back guarantee only for new shared hosting purchases.

This guarantee does not extend to dedicated servers, VPS, cloud hosting, WHMCS modules, or any other services.

This guarantee applies only to first-time purchases by a new client and does not cover additional purchases, renewals, or upgrades.

After the 15-day period, all fees are nonrefundable unless expressly stated otherwise.

No Prorated Refunds: RackNode does not provide prorated refunds for cancellations made during a billing cycle.

5. Abuse / Violation Terminations:

    • No Refunds for Abuse: If your service is suspended or terminated due to abuse or a breach of our T&C or AUP, no refunds will be issued.
    • We reserve the right to take immediate action to protect our network, other users, and upstream providers.

6. Service Level Agreement (SLA)

1. Availability: We strive to meet or exceed our committed uptime and performance targets. Specific uptime guarantees and remedies (if any) are described in our SLA, accessible on our website.

2. Compensation: The SLA details any credits or compensation due in the event of failure to meet stated service levels. Such compensation, if offered, is typically limited to service credits only and does not extend to indirect or consequential damages.

7. Intellectual Property Rights

1. Client Content: You retain all intellectual property rights over content you create and store on RackNode servers. By using our services, you grant us a limited license to host, transmit, back up, and display your content as needed to provide our services.

2. RackNode Intellectual Property: We and/or our licensors retain ownership of all RackNode trademarks, trade secrets, patents, and copyrighted materials. You shall not reproduce or distribute RackNode’s materials without explicit permission.

8. Liability and Indemnification

1. Limitation of Liability:

RackNode shall not be liable for any direct, indirect, incidental, or consequential damages that result from the use, misuse, or inability to use our services.

Our liability is limited to the amount you paid for the relevant service during the last billing period.

2. Indemnification:

You agree to indemnify and hold RackNode harmless from any claims, damages, liabilities, or expenses arising from your violation of these T&C, our AUP, or any applicable law, including but not limited to intellectual property infringement, defamatory content, or malicious activities originating from your account.

9. Changes to Terms and Conditions

  • RackNode reserves the right to modify or update these T&C at any time.
  • We will notify clients by posting the updated T&C on our website or through direct communication. Your continued use of our services constitutes acceptance of any modifications.

10. Governing Law

  • These T&C shall be governed by and construed in accordance with the laws of the United States of America, unless another jurisdiction is specified in writing.
  • All disputes arising under or in connection with these T&C shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
