These Terms and Conditions govern the use of services provided by RackNode, a brand operated by Mustafa Tech LLC. They apply to RackNode VDS, dedicated servers, software modules, and related services ordered from our website or client area.

These Terms and Conditions ("Terms") govern your access to and use of RackNode services. By creating an account, placing an order, paying an invoice, or using any RackNode service, you agree to these Terms, the Acceptable Use Policy, the Privacy Policy, and any service-specific terms presented on the applicable order page, invoice, or product page.
If you use RackNode services on behalf of a company, organization, or other legal entity, you represent that you have the authority to accept these Terms on that entity's behalf.
Service-specific descriptions such as hardware specifications, bandwidth, deployment windows, or managed add-ons apply together with these Terms and control for that service if there is a direct conflict.
RackNode provides infrastructure and software-related services that may include VDS/VPS hosting, dedicated servers, software modules, and related support or network services. The exact features, hardware, port speed, storage, IP allocations, pricing, and deployment estimates for a service are defined by the product page, quote, or invoice for that service.
Unless a managed add-on or separate written agreement clearly states otherwise, RackNode services are provided on an unmanaged basis. We maintain the underlying network, virtualization layer, node, or hardware associated with the service you purchase. You remain responsible for the operating system, applications, data, security posture, and configuration inside the service.
Provisioning times listed on the website are estimates and not guarantees. Availability may vary by region, hardware stock, and datacenter capacity.
Software products or modules may also be subject to separate product-specific terms, including the Stripe Checkout Module Terms & Conditions.
You must provide complete, accurate, and current account, contact, and payment information when you sign up for RackNode services. You are responsible for keeping that information updated so we can send billing notices, service notices, and security-related communications to you.
All RackNode services are billed in advance according to the billing cycle shown at checkout or on the applicable invoice. By ordering a recurring service, you authorize RackNode to charge the payment method associated with your account for the selected billing cycle.
RackNode reserves the right to increase pricing for a future billing cycle or renewal term, including in cases of inflation, currency devaluation, increased datacenter, network, software, licensing, payment processing, labor, or other operating costs, market conditions, or any other business reason. Any such price change will apply no earlier than your next billing cycle after notice is given. Notice may be provided by email and/or by posting the update on our website.
You may request cancellation through the client area or by contacting support before the next billing date. Cancellation stops future renewals but does not retroactively cancel the current billing term. Unless a product page states otherwise, partially used service periods are not prorated.
Except where required by law or expressly stated in a written offer, fees paid to RackNode are non-refundable. RackNode does not provide prorated refunds for cancellations made after a billing period has started.

RackNode targets a 99.9% uptime commitment across core hosting services. If an eligible service falls below that uptime target during a billing month, you may request service credits for the affected service.
Support is provided according to the product you purchase. For unmanaged server services, RackNode support focuses on service availability, hardware, virtualization, provisioning, and network connectivity. Administration of your operating system, code, mail stack, snapshots, and applications remains your responsibility unless a managed add-on or separate written support scope says otherwise.
You are responsible for using RackNode services lawfully and in a manner that does not harm RackNode, other customers, upstream providers, or third parties.
RackNode may suspend, restrict, or terminate services with or without prior notice when reasonably necessary to protect our network, other customers, our upstream providers, or to comply with legal obligations.
Because suspended or terminated services can become unavailable immediately, you should not rely on a RackNode service as the only copy of important data.
You retain ownership of the content and data you place on your services. You grant RackNode a limited right to host, transmit, cache, back up, and otherwise process that content only as reasonably necessary to provide the services you ordered. RackNode and its licensors retain all rights in RackNode branding, website content, software, and documentation that are not owned by you.
To the maximum extent permitted by law, RackNode is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from or related to your use of, inability to use, or interruption of our services. RackNode's total liability for a claim related to an affected service is limited to the amount you paid for that service during the billing period immediately preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold RackNode harmless from claims, losses, damages, liabilities, and expenses arising from your content, your use of the services, or your violation of these Terms, the Acceptable Use Policy, or applicable law.
RackNode may update these Terms, service descriptions, or pricing from time to time. Changes become effective when posted on this website or otherwise communicated to you, unless a later effective date is stated. Continued use of RackNode services after updated Terms take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the United States of America. Nothing in these Terms limits liability that cannot be limited under applicable law.
